eBay problems... what to do?

I think I just got scammed. I won a part nearly a month ago (will be a month tomorrow). I thought it was odd that he wanted a money order [yellow flag] but I complied anyways. I sent a USPS M/O via Priority Mail with a Sig Confimation a couple days later, this was on a Friday. Monday was a Holiday so I figured Tuesday would be the earliest it would be delivered. I tell the seller this and he informs me that he will be going out of town for the week [yellow flag] and that his girlfriend will sign for it. It was signed for on Friday. The following Monday or so I get an email from him stating that he did not recieve the payment [red flag]. This is when I check the Sig Con and tell him who signed for it (wasn't him but had the same last name) and he then tells me "Oh, that's my parents house". [red flag] What?!? You don't know what address you gave me? Is what I'm thinking... but I keep it cool because I don't want to tarnish my precious spotless eBay record as of yet. Anyhoos, a couple days later he says he's gonna ship and those days turn into weeks and I honestly have been working so much overtime the last couple of weeks that I forgot about them. I would shoot him an email every now and then and the replies have dried up and I am getting ready to file a complaint nearly a month later.

I know I probably won't get my money back and I have already replaced the part but I would like to know what my options are seeing how I did not pay via paypal. I should of just known better in the first place.

This sucks because he doesn't have a negative... thus far, even thought it is low. =/

I just googled the address and it is a 500K home FOR SALE! Tried the name and username with no luck...

Any help is greatly appreciated. Thanks

File a complaint with E-bay.How high is his feedback rating?

Allegedly there is a specific amount of time that you have to leave feedback. I'd just wait till the last possible day/time to do so and leave a negative. Seems low, but when you're not in the wrong it's a good way to protect your feedback rating.

Yeah that doesn't work.  They get more time after you leave feedback to leave more for you.

Don't worry about tarnishing your record - if you got scammed, let the world know it. Any regular eBay user will know that any neg he leaves for you would be a retaliatory one.

As for the legal aspect - contact USPS to see if the money order was cashed. If it was, have them assist you in charging the person for mail fraud. Using the mail system to commit fraud is a felony. USPS supposedly has been cracking down on this because it's damaging their reputation as being a safe way of paying.

If that doesn't work I'll get the gun and we can road trip it. I will drive!

That just sucks, same thing happened to me and I was unable to do anything.

I just got an email from him last nite. He said that there was a flood in the DFW area and his internet connection has been out until recently. Anyone in the DFW area or Texas know of this flood? I haven't been keeping up with my current events.

i'm about an hour and a half from there.I know they had a lot of rain last week.I don't know of any flooding,and,the weather has been good for a week.It would be hard for me to believe that service would be down that long,and,he doesn't need service to mail your package.Your package showing up in your mail box would be a good enough reply.

I live in the DFW area... but it's a big area and some parts are pr0ne to flooding while others aren't. We did have some heavy rain about 2 weekends ago which could've caused flooding in some areas. What city is he in, exactly?

And Vinnie is right, what does internet service have to do with shipping your stuff? Sounds like this dude is full of ...

Yeah it's sounded like an excuse to me too... just because the internet is down doesn't mean you can't ship.
 
The address was to Ponder, TX. But it sounds like that's his parents place so there's no telling where his exact addy is. He didn't mention anything about his home or property being damaged so I'm thinking he could be just buying more time.
 
He said he was going to ship today so we shall see.

  That sucks man. Id say its #2 next to credit card fraud in the country so they are looking to crack down on it. 2 things you have against you is (one) there to much on there plate when it comes to crime like this so they pic and chose what they want to deal with and (two) you are far from him leaving a lot of jurisdictions between you. With lead to the individual company’s doing the investigation and turning it over to the local/proper authority’s so my advice, and I’m not 100% it would even work is do a lot of leg work yourself  making it an easy for them and don’t forget to be a thorn on everyone side, keep on top of them.

Ok some progress has been made. After filing an "Item not Recieved" last week he finally came around and now I have a tracking number and a refund of my shipping costs. Now all I have to do is wait for the package to arrive.

regurdless, id set up a webpage explaining the whole event with whatever evidence you have and be prepared to link it to his feedback. if you actually get it, id leave at least a neutral stating basically that the guy is a duschebag, cant be trusted but you eventually got your stuff.
