2008 Thundercats Calendar - Now Available to Forum Members!

Awesome work on the calender and awesome work getting the permission!

I welcomed the dark side and currently am driving a 2000 Dodge Durango SLT plus, with a 5.9, Code named project "Night Runner"
Shes black on black, fully loaded, with headers, 180 tstat, e fan, straight exhaust into a cherry bomb vortex ler, full tune up, ported intake and T/B, MSD coil, and round aircleaner.
Mods to come: Fully rebuilt and heavily modded 46RE, and a richmond rachet locker.

Moving to marketplace section at Cougars2Go's request - apparently it's got something to do with FoMoCo's permissions that we shouldn't advertise it in a section of the forum that is viewable to guests/not logged in people. The marketplace is viewable only to members logged in.

Was permission given because our calendar did not violate their trade dress copyright, or because they were being nice and cut us some slack?

If it were being offered for sale to the general public on the open Internet, then it would be a trade dress violation.  If these calendars were being offered for sale to the general public at something like Ford Carlisle, then that would also be a trade dress violation.

They have approved it for "internal club use" only, or in our case for forum members only.  That's why I moved the pre-order thread I created to the marketplace section and asked Thunder Chicken to move this thread that Ether947 created to the marketplace - it's only viewable if you are logged in.

It seems as if us and the BMC arrived at two different agreements.

We've been watching this discussion with interest and I'd like to
clarify what is essentially a misunderstanding.

Yesterday we spoke to both Cafe Press and the Black Mustang Club
and explained the situation (about the Black Mustang Club’s calendar) to everyone's satisfaction. Ford has no problem with Mustang or other car owners taking pictures of their vehicles for use in club materials like calendars. What we do have an issue with are individuals using Ford’s logo and other trademarks for products they intend to sell. Understandably, we have to take the protection of our brands and licensing very seriously.

Ford did not send the Black Mustang Club a “cease and desist” letter telling them that they could not use images of their own cars in their calendar. The decision not to allow the calendars to be printed was made by Cafe Press, because we had gotten in touch with them in the past about trademark infringements on products they sold.

The Black Mustang Club, and any other Ford enthusiast club, are free to take pictures of their own vehicles for use in calendars or other materials as long as they don't use Ford trademarks in products that will be sold.

I think it is great that the Black Mustang Club, and any other enthusiast club, would take pictures of their own vehicles for use in calendars or other materials.

I'm looking forward to purchasing a copy to hang in the garage next
to my Mustang (even if mine isn't black).

If "sold" only references 'for profit', then it makes sense.

However, BMC is offering their calendar sale to non-members and has the item for sale on a 'public' portion of their website, unlike us.

that's really awesome I like how the pictures are set up on each page, instead of just a big image you get info and a few detail shots with one nice big one.

Methinks Ford's lawyers were wrong.

Photo Attorney -  Does Ford Own the Copyright in Your Photos?


I think it is clear that our calendar does not cause confusion as to the source of the product or dilutes the trademark by blurring or tarnishment, and thus is in the legal clear.

The point is moot since Ford could proceed with litigation and bury anyone who tries to disagree, but still...the view from the moral high ground is amazing.

I assume this is because our calendars have actual Ford logos on them, and the BMC does not. The lack of standalone logos makes the BMC calendar free of Intellectual Property problems, whereas we need Ford's permission to keep the logos in. 
I ordered one before the CafePress clampdown - the news ones do have logos in them, correct?

I removed the logos from all the layouts, except for Gunkel's. His is in the background of the photo and there's not much (other than changing the photo out -- I didn't want to it is awesome) I could do about that. I will revisit the distribution issue with cafepress/Ford for the 09 Cal.
